Rental Agreement

THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL
1. CHECK-IN/OUT: Check-in is after 4 P.M. EST and check-out is 11 A.M. EST. No early check-ins are permitted. Due to time constraints of the cleaning crew there will be a minimum fee of $50 for any late check-out.
2. SMOKING: This is a non-smoking cabin. The Damage Deposit will be forfeited and an additional fee charged for deodorizing the cabin whenever smoking is believed to have occurred.
3. PETS: Pets are NOT permitted in the cabin. NO EXCEPTIONS. The Damage Deposit will be forfeited and an additional fee charged for cleaning whenever animals are believed to have been present in the cabin.
4. MINIMUM AGE: We will not rent to anyone under 21 years of age unless accompanied by an adult guardian or parent. Vacationing students or others attempting to circumvent this rule will forfeit all rental monies, including the Damage Deposit, and will be evicted from the premises immediately.
5. DAMAGE DEPOSIT: $150 of your total payment serves as a damage deposit. The deposit is NOT applied toward rent; however, it is fully refundable approximately fourteen (14) days after departure, provided the following provisions are met:
a. No damage is done to cabin or its contents.
b. No smoking or vaping in the cabin has occurred.
c. No pets have been present on the property.
d. No illegal drugs, including marijuana, have been used on the property.
e. No underage drinking has occurred.
f. All debris, rubbish and discards are placed in refuse containers outside and the lock has been engaged.
g. Soiled dishes are placed in the dishwasher and the dishwasher cycle has begun.
h. Soiled towels and linens are left on the floor.
i. Refrigerator and freezer have been cleared of all opened items.
j. The thermostat has been set to 60 degrees.
k. Gas fireplace and ceiling fans are turned off.
l. Cabin is left locked.
m. All charges accrued during the stay are paid prior to departure.
n. No linens are lost or damaged.
o. No early check-in or late check-out has occurred without prior approval.
p. Maximum occupancy of six (6) persons has not been exceeded.
q. No theft has occurred.
r. No charges are incurred due to smoking, pets, extra cleaning, theft, vehicle towing, or collection of rents or services rendered during the stay.
s. All furniture, décor and appliances have not been moved.
t. All provisions of the Rental Agreement have been followed.

6. CLEANING FEE: There is an additional charge of $110 for cleaning the cabin after your departure.
7. PAYMENT:
- Zelle or PayPal: You must have a Zelle or PayPal account to book through our website. Booking is available through VRBO if you prefer to use your credit card. Reservations require a payment of 50% of the total amount to hold your reservation. The balance of all fees must be paid at least forty-five (45) days prior to the arrival date.
- Cashiers Check: Full payment must be received within three (3) days of making the reservation and no later than forty-five (45) days prior to the arrival date.
8. CANCELLATIONS OR TRANSFER OF DATES: Should your plans change, there is a minimum $50.00 cancellation or transfer of dates fee. (Sorry, no exceptions.) The following guidelines will apply:
- Cancellation or Transfer of Dates is made forty-five (45) days before arrival date: You will receive a complete refund minus a cancellation or transfer of date fee of $25 per day for each day reserved.
- Cancellation or Transfer of Dates is made within thirty (30) days of arrival date: For cancellation, the full rental fee (including taxes) will be forfeited. The Damage Deposit and cleaning fee will be refunded. For Transfer of Dates, a fee of $50 per day for each day reserved will be required. We are not like a hotel that can re-rent on short notice.
- Early Departure: No credit or refund will be given for an early departure. All charges for the scheduled stay will apply. (Sorry, we have to pay the bills, too.)
9. LONG RESERVATIONS (Two Weeks or More): There is no price reduction for long term rentals. In addition, renters must agree to a weekly cleaning at the normal cleaning rate. Payment must be made in full at least one hundred twenty (120) days in advance. Renters who cancel one hundred twenty (120) days prior to the scheduled arrival date will receive a full refund minus a $25 per day cancellation fee. Cancellations after this date will result in the forfeiture of all fees except the Damage Deposit and cleaning fee.
10. MAXIMUM OCCUPANCY: No more than six (6) adults or six (6) persons total may be in the cabins at any time. Guests are only allowed if the total occupancy at any time does not exceed six (6). An adult is defined as anyone who has reached their 18th birthday.
Any party found to be in violation of this policy will forfeit their entire Damage Deposit and incur an additional charge of $25.00 per person per night.
If guests are found to be in violation of this policy while inhabiting the premises they will be evicted immediately and lose all monies associated with their stay.
College students and group parties: You have been warned!
11. INCLUSIVE FEES: Rates include a one-time linen-towel setup.
12. NO DAILY MAID SERVICE: While linens and bath towels are included in the cabin, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the cabins.
13. RATE CHANGES: Rates are subject to change without notice.
14. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense (including, but not limited to, the number of persons staying in the cabin OR animals present) will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will be evicted or not permitted to check in.
15. PARKING: Parking is limited to two (2) vehicles per cabin. Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing. All applicable fines/towing fees will be paid by the vehicle owner.
16. HOT TUBS: When using the hot tub, remember there are certain health risks associated with this facility. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs as necessary. Therefore, the hot tub may not be warm until later in the evening. Hot tub covers are for insulation purposes ONLY and are not designed to support weight. DO NOT STAND OR PLACE OBJECTS OF ANY KIND ON THE HOT TUB COVERS; they will break and you will be charged for replacement. Remember, when not using the hot tub; leave the cover on so that the hot tub will stay warm. If the hot tub fails, we will do our best to have it repaired, but please understand there is no such thing as an emergency hot tub repair! Hot tub repairmen have lives too.
17. WEATHER/STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms, hurricanes, inclement weather, or acts of God. Mountain roads can be curvy and steep. Gravel drives are well maintained, however we highly recommend four wheel drive and/or chains during the snow months. No refunds will be made due to road conditions and we cannot pay for or arrange for towing of vehicles that have become stuck.
18. CIRCUMSTANCES BEYOND OUR CONTROL: No refunds will be given for circumstances beyond our control. This includes severe or inclement weather, failure of public utilities or outside services. This includes, but is not limited to, electricity, heat, and Wi-Fi. If the hot tub fails, we will do our best to have it repaired, but please understand there is no such thing as an emergency hot tub repair!
19. LIABILITY: Our cabins are privately owned. The owners are not responsible for any accidents, injuries or illness that may occur while on the premises or its facilities. The Owners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
20. ITEMS LEFT AT THE CABINS: Any items left behind by our guests will be returned only if requested by the guest. There will be a minimum charge of $25.00 plus the cost of shipping and insurance. The total amount will be charged to the guest and may be deducted from the damage deposit at our discretion.
21. WRITTEN EXCEPTIONS: Any exceptions to the above mentioned policies must be approved in writing in advance.
22. ACCOUNTING: All monies paid in advance are held in an account at First Citizens Bank, 1825 Kildaire Farm Rd., Cary, NC 27518 or, if booking occurred through VRBO or HOMEAWAY, in accounts held and controlled by them.
